Status of the Children

Your child is considered to be a Canadian citizen, if at least one of the biological parent is born in Canada. If one or both the parents are born in Canada, then you may need to get the Government of Canada to confirm that your children really have Canadian citizen status. To do so, you must apply for proof of citizenship, before returning to Canada.

If one or both biological parents were not born in Canada but have received Canadian citizenship, your children may not be considered Canadian citizens. In such a case, you may have to sponsor them to come to Canada, with you.

Prior to the pandemic, Canada was aiming to welcome 70,000 new immigrants under its Spouses, Partners and Children category. Under its new 2021-2023 Immigration Levels Plan, this target will increase to around 80,000 annually moving forward.

New Data by IRCC

Latest data provided by IRCC shows that the number of spousal sponsorship applications that have been finalized by IRCC doubled in September 2020 compared with July. In September, IRCC finalized and decided upon just over 4,000 applications, compared with just under 2,000 in July. Both in-land and overseas applications have seen significant improvements.

Given IRCC’s announcement in late September about expediting the processing of spousal applications, we should expect even higher levels of finalized applications for the remainder of 2020.

On 24th September 2020, the Immigration minister of Canada, Marco Mendicino, announced plan of action to swiftly deal with Canada spouse visa applications. This speeding up of application processing came in view to help families in Canada reunite and excel their future.

IRCC has increased number of decision makers for approval/disapproval of spousal applications in Canada. The overall number has seen increase of 66% to facilitate families and couples with speedy processes.

IRCC has decided to adapt to a new technology in a pilot to digitalize applications instead of paper application. This is to ensure that the applications are processed even more efficaciously by IRCC staff is working distantly as well as at various worksites. In addition, IRCC will be piloting, in the coming times, new technology to hold interviews for the applicants in a remote way, in compliance with public health guidelines.

Temporary Resident Visas (TRV) are generally not granted because spousal sponsorship applicants from visa required nations need to prove that they would not stay in Canada if their validity terms gets over and if their PR application isn’t finalized.

Despite of foreign spouses of Canadians being exempted from travel restrictions, the epidemic is still giving a hard time to the couples. Biometric centers are closed across the globe or being operated at a decreased capacity, deeming the processing to be slower than before. Also, foreign fiancé isn’t exempted from travel restrictions and IRCC refrains from recognizing virtual marriages for immigration purposes.
