Prior to the pandemic, Canada was aiming to welcome 70,000 new immigrants under its Spouses, Partners and Children category. Under its new 2021-2023 Immigration Levels Plan, this target will increase to around 80,000 annually moving forward.

Latest data provided by IRCC shows that the number of spousal sponsorship applications that have been finalized by IRCC doubled in September 2020 compared with July. In September, IRCC finalized and decided upon just over 4,000 applications, compared with just under 2,000 in July. Both in-land and overseas applications have seen significant improvements.

Given IRCC’s announcement in late September about expediting the processing of spousal applications, we should expect even higher levels of finalized applications for the remainder of 2020.

Some couples applying for spousal or common-law partner sponsorship want to first apply for a Temporary Resident Visa (TRV) and then come to Canada to apply for inland sponsorship. The Government of Canada now gives you an option to apply for Spouse Immigration and Spouse Visitor Visa. It is now OK to apply for permanent residence, even though you currently have a status of a temporary resident. That means, applying for temporary residence, of any kind, does not stop you from applying for permanent residence.

The Immigration, Refugees and Citizenship Canada (IRCC) defined described ‘dual intent’ as below:

“An intention by a foreign national to become a permanent resident does not preclude them from becoming a temporary resident if the officer is satisfied that they will leave Canada by the end of the period authorized for their stay.”

Even so, some applicants were refused because they were incapable of proving that they would leave the country, once their documents duly expire.

IRCC, on October 30, updated their program delivery instructions for officers, explaining thereof, considerations to take when reviewing spousal sponsorship applications. Particularly, those who have applied for a TRV. Immigration officers are instructed to consider the individual circumstances of foreigners who are being sponsored for permanent residence as a spouse or common-law partner.

The following are the factors that the immigration officers are instructed to consider:

  • whether the sponsorship application has been approved;
  • whether the application for permanent residence has received stage one approval;
  • to what extend the applicant has retained ties in their home country; and
  • if their application is refused, what is the applicant’s plan?

Conclusively, the candidates must convince the immigration officers that they will stay in Canada as long as they have legal status in Canada.

How will Immigration Officers assess your Application?

There is a difference between temporary residents who intend to leave Canada, and those who do not intend to leave at the end of their authorized stay if their application for permanent residence is refused.

When officers assess the applicant’s intentions, they are told to look at the individual circumstances of the temporary residence applicant.

Among other factors, officers consider the following when assessing an application for temporary residence:

  • the length of time the applicant will spend in Canada;
  • their means of support;
  • obligations and ties to the home country;
  • the purpose and the context of the stay;
  • the credibility of documents and information submitted; and
  • past compliance with Canadian immigration laws, and information available in biographic and biometric information sharing.

It has been ensured that each applicant is to receive a “procedurally fair, individual assessment”.

If an officer has concerns or doubts about the applicant’s intentions, the applicant must be made aware of these concerns and given an opportunity to respond. If the officer does not approve the application for temporary residence, the officer must give the applicant a letter explaining why they were refused.

They will use their own judgement on applications with dual intent, but the Global Case Management System notes should clearly demonstrate the officer’s reasoning when assessing the application. If dual intent was taken into consideration as part of the decision on the application, it should be mentioned in the concerned applicant’s file.

Spouse and common-law partners will soon be exempted from travel restrictions. Canada is opening up the border to allow couples to reunite, starting from 8th October 2020.

Couples who have been in an exclusive dating relationship with a Canadian citizen or permanent resident for at least one year, and who have spent time in the physical presence of their Canadian partner during the relationship, as well as their dependent children are eligible to enter Canada under this update. They will not need an essential reason to enter into Canada until they are going to stay for over 15 days, and fulfill the current eligibility and admissibility requisites.

They also need to:

  • Submit the necessary documentation to IRCC, and signed statutory declaration to demonstrate that they fall under the definition of an “extended family member” of a Canadian
  • Have a valid passport as well as travel documents
  • Carry a written authorization from IRCC to travel to Canada as an extended family member

IRCC has said that elaborate information, such as the precise definition of extended family, as well as the criteria, will be provided on 8th October 2020. In a latest survey conducted by the Association of Canadian Studies, Canadians demonstrated absolute support for prioritization of family reunification rather than prioritizing economic-class and refugee-class immigration in the year 2020.

No doubt, Canadians hold a very generous perception towards immigration and truly believe that it is essential for the recovery of Canada’s economy. However, they showed utmost compassion in the survey by stating that family members should be getting the nod for immigration over anyone else.

Due to the COVID-19 pandemic, the immigration intake is declining. Family sponsorship went through a slump of 78% in the 2nd quarter of this year as compared to the same phase last year.

RELEVANT STATS

Around 36% of the survey participants said that the family of people already staying in Canada should be given more importance this year. This percentage was meagre 30% in 2016.

Almost 61% participants opined that immigration is beneficial, 22% of them stated that it would adversely affect Canada’s economic recovery and 18% had nothing to say about it.

Survey partakers from Atlantic Canada were of the opinion that immigration would be advantageous for Canada (67%). The people who were in favour (52%) significantly outnumbered those people who contradicted (26%) and those who had nothing to say (22%).

A pilot or an experimental program introduced by Canada, allows spouses and common-law partners of Canadians or Permanent Residents to be granted an open work permit while their inland sponsorship application for permanent residence is under process.

The program began in December 2014, and was set to expire on July 31 after its most recent extension. Instead of setting another expiry date, Canada is now extending the program until the regulatory changes have been completed to implement the pilot as permanent policy.

Immigration, Refugees, and Citizenship Canada (IRCC) has recently said that family reunification is a “core immigration priority for the Government of Canada.”

The OWPP applies to inland spousal and common-law sponsorship applicants. Inland sponsorship is for couples who are already living together in Canada. The partner who is applying for immigration needs to already have temporary status in Canada as either a worker, student, or visitor.

The foreign partners of Canadians can apply for the open work permit any time after they have applied for permanent residence through family-class sponsorship.

Open work permit allows foreign workers to work for any employer in Canada so long as they meet the occupation’s qualifications.

In order to be eligible for an OWPP, immigration candidates need to meet the given criteria:

  • submit a permanent residence application under the Spouse Common-Law Partner Class;
  • have a Canadian citizen or permanent resident spouse or common-law partner who has submitted a sponsorship application on their behalf;
  • live at the same address as their sponsor; and
  • have a valid temporary resident status in Canada, or an approved application for restoration status with authorization to work.

People applying under the OWPP can submit the work permit application at the same time as their application for permanent residence. Applicants can also submit the application for the OWPP separately, if they have already submitted their application for permanent residence.

Applicants can apply for OWPP online, if they have already received approval in principle on their permanent residence application. Approval in principle (AIP) means the spouse or partner has received a letter from IRCC, stating that they meet the permanent residence eligibility requirements, but they have not yet passed the medical, security and background checks.
